From Glenn Kirschner,

“The language in Smith’s new court filing is unlike anything I’ve seen (in federal court) in my 30 years of prosecuting criminal cases. I’ve never seen such a direct criticism and rebuke by prosecutor of a federal judge, coupled with the threat of an appeal (writ of mandamus). It’s both extraordinary and absolutely necessary, as Judge Cannon is an impediment to the due administration of justice.

This is a positive development.”

I am assuming that she is either under the Federalist Society thumb since she is a member, or her hubby is ruling from home, or she is afraid of the consequences in her social circle (of Treacherous-treasonous-tantruming-traitor-Trump supporters), and the howling mobs that support him through violence which she does not want to be a victim of. I am assuming she hopes the 11th circuit steps in and kicks her off the case and saves her butt. But then again, it is probably because she is bought and paid for by someone. Of course, that will drag it out some more because any new judge will have to get up to speed.

One would hope so, but according to this morning's news it sounds like she is trying to avoid Jack Smith being able to get rid of her in today's Washington Post. Or, do you read it differently? https://www.washingtonpost.com/national-security/2024/04/04/cannon-trump-jack-smith-presidential-records-act/

No, that is exactly what it sounds like. I have the feeling that the judge is digging herself into a hole though. We'll see. Trump's motion is so absurd that you have to question her approach, which delays the trial.

The upside is that, unlike Thomas and Kavanaugh, she DOES have people that she has to answer to, and they've shown that they are willing to jerk her leash. She's perilously close to losing her place on this trial, and perhaps her place in the judiciary.

I hope they become more and more difficult to sustain. And by the way, whatever the hell happened to fatigue. Remember how we were once upon a time able to count on presidential fatigue, anger fatigue, idiot fatigue, and there'd be just a general change that would quietly but suddenly and completely wave across the crowd and everybody was just done. Trump has been able to keep that rage thing going for far, far too long.

She actually was rated Qualified but there are three possible ratings…Unqualified, Qualified, and Well Qualified. She was only rated Qualified, most likely because she was barely qualified. She only participated in four criminal jury trials - two as lead counsel and two as associate counsel. One of those criminal trials was for a man who threw a chair at the federal prosecutor when he was found guilty. All of the other cases were resolved with plea deals. The same with the trials she has presided over as a judge. They were mostly for undocumented immigrants who had reentered the United States. The cases at most had a sentence of 1 1/2 years. She is in no way experienced enough or qualified to handle this case.

He's cruel because not too far deep down, he really knows he's nothing. So all the adulation is like a drug for him. This is my take on that. He has been doing this all his life. He had a monster of a father who was successful in expunging humanity from DJ but not one of his brothers, Mary Trump's father who died of alcoholism, gee, wonder why. I think that was her father. And Trump was taught that the worst thing in the world was being weak and being a loser. His father said all that. And he's probably always known he was a loser and all this adulation he requires, it's the only thing that gives him a shot at being Not A Loser because idiots like him. So this is like an addict. He's always out there looking for his fix and his base is his stash. He will never not go to his stash. No matter how repulsive, how disgusting and how reprehensible. He has been without empathy, sympathy and conscience all of his life and it's only gotten worse. He always gets rescued. He was done and washed up when The Apprentice came along. And it just kept this monster going. Otherwise, he'd be a tiny small psychotic, psychopathic, sociopathic blob sitting in his fake gold properties blowing smoke up his own ass because nobody else would take him seriously for 2 flash-by seconds. He represents the sickness endemic in the U.S. We really need to find a way to crush this.

We know what a nice life is. he only knows fear, revenge, cruelty, hate. Insecurity. He's a mass of horrors.

Expand full comment

I disagree. Trump was schooled on the legal system from Roy Cohn, who also was a Federal attorney. He took that work experience to heart when his business was defending criminals. And Trump was a good student of his. But in the end, he "forgot" who Cohn was when he was no longer useful. He is not an intellectual but he is clever and devious. And he knows how to work the system.

Expand full comment

Little story after it was clear Cohn was dying of AIDS, Trump dropped him and of course never one word of sympathy or anything human. And Cohn, we all agree I'm sure, a truly hideous monster himself, said of Donald, "He has ice water running through his veins." And that has been proven over and over.

I keep begging the friendly universe to turn this upside down world right side up again. Every single day that the former guy is alive is another day of massive bullshit and crap piling high. Trump, his Bible and his God – A stand-up comics dream

“Trump has “many Bibles” because each time he holds one up it burst into flame.” Hallelujah

The Lord said: “I will stretch out my hand, that I may smite thine traitorous orange flesh and thou shalt be cut off from the earth. And it was good.”

Keith Olbermann’s top story this morning outlines the threat of a police state if t* is elected. https://www.youtube.com/watch?v=UFfu3VtihXw

The evil one wants to federalize state and local police. Think about that, every policeman in this country reporting to trump. Just another threat or could he employ his own SS? This quote encapsulates that possibility.

“First, they came for the Communists, and I did not speak out because I was not a Communist, then they came for the Socialists, and I did not speak out because I was not a Socialist. Then they came for the trade unionists, and I did not speak out because I was not a trade unionist. Then they came for the Jews, and I did not speak out because I was not a Jew. Then they came for me and there was no one left to speak out for me.” German pastor Martin Niemöller, who openly spoke about his own early complicity in Nazism and his eventual change of heart. His powerful words about guilt and responsibility still resonate today.

The defense arguments here are maddening. A claim that the specific content of each document stolen is important for jurors to consider is like the defense attorney for a bank robber questioning the real value of paper currency.

The theoretical and abstract arguments are pure distraction to give the rubes of Trump's base, right-wing media, and the "in-the-bag" Judge Cannon a fig-leaf to shield the tiny mushroom from due scrutiny.

The fact is that these documents were legally classified, Trump took them without the authority to do so, and when asked to give them back he undertook a clear pattern of obstruction. All of these are obvious and clear-cut crimes that need to be punished.

Expand full comment

I do not care if Trump took a coaster from the White House, he broke the law. The whole classified discussion is a convenient distraction. Ooooh. Let's spend cycles arguing about super duper classified. Hmmm. It's only classified if I say it is! I can declassify something by hand-waving or thinking it...For the love of God, the argument should be: "You took stuff that is not, was not and never will be yours and lied repeatedly about it. Then you forced other people to destroy the evidence of your lies. And the fact that you knew what you were doing was wrong is on tape and has witnesses."

Indict Aileen as a co-conspirator. Her "ignorance" isn't real. Her obstruction of justice is. Somewhere, Aileen has been sloppy and left a bread crumb as to her motives. Find it the way Trump's team scoured Fani Willis' Aruba bar bill. Unlike the criminals in the SCOTUS eating bon bons from their triclinium on Palatine Hill, there are standards and limits for Federal judges.
