Two considerations:

if even if the prosecution doesn't call the victim as a witness, Trump's defense certainly will, So she will be put in extreme danger.

This offense is at most a misdemeanor. So trumps defense could bring up other incidents in which it wasn't prosecuted— selective prosecution. They would have to prove that Trump himself knew that the photographer was not allowed and permitted him to function anyway. Otherwise, they can prosecute only those involved in the assault on the woman.

The article states Trump and staff were advised of these laws.

We know that his staff was advised, we'd have to prove that this information reached Trump.
