Law enforcement almost never pursues an investigation when the victim is unwilling to press charges. The victim would have to be compelled to testify against the perps. I see no way of protecting the anonymity of the victim with 70 million people wanting to uncover it. A coworker could make thousands of dollars selling that information.

The problem of a witness who is too frightened to testify was partially solved by the witness protection program. The witness was moved across the country and given a whole new identity. I doubt the army employee wants to uproot her life in that way. The witness protection program has been primarily used for mafia informants who were testifying so that they didn't go to jail themselves.

Two considerations:

if even if the prosecution doesn't call the victim as a witness, Trump's defense certainly will, So she will be put in extreme danger.

This offense is at most a misdemeanor. So trumps defense could bring up other incidents in which it wasn't prosecuted— selective prosecution. They would have to prove that Trump himself knew that the photographer was not allowed and permitted him to function anyway. Otherwise, they can prosecute only those involved in the assault on the woman.

Damnit, I've never understood that antiquated part of law, that still exists to this day. A woman (usually, but not always) to walks into a police station,to file a report of domestic abuse, and unfortunately has go back to the home where the abuse is occurring, and the freakin' goon will literally beat the victim into recanting her testimony. And the cops say 'We have to have the victim's testimony to prosecute the crime', WHAT??!! BEATING THE SHIT OF ANYBODY IS A GODDAMN CRIME!! PERIOD!! A lot of states still have these ridiculous laws on the books,it pisses me right off.

Expand full comment

Fortunately, there exists a large number of battered women's shelters where women who have been abused can get away from their abusers.

My close friend Scott had an interesting experience. A woman who lived in his apartment complex showed up with a black eye, about which he inquired. After repeated inquiries she confessed that her husband had hit her. He convinced her to go to a battered women's shelter.

The drunk husband later confronted him in a convenience store parking lot with a gun in his hand. My friend, who was an untrained but extraordinary street fighter, kicked the man in his jaw and broke it, while knocking the gun out of the man's hand. The drunk fell backwards, and Scott and another man sat on the drunk until the police came. When the police showed up, the man claimed that Scott had assaulted him. Fortunately, security footage proved otherwise. Under the laws of the state of Texas, this man was due about 10 years in jail. I don't know what happened, but hopefully this gave his wife plenty of time to restart her life.

Expand full comment
bruce somers's avatar

Terrible story, sometimes the stories of abuse victims end in tragedy, and sometimes fatalities. I was watching a court show once,a woman was being beaten her boyfriend, for years, her neighbors hear that she's being beaten, and call the cops, she's bloody and black and blue, they drag the jackass off to jail, where he belongs, end of story...but wait, there's more...the jackass starts calling her from jail, 'Please baby!!! I'm so SORRY!! It'll never happen again!! Just bail me out!!' Unfortunately, she does...ugh. The reason they're in court?? He doesn't want to pay back the bail money she put up,and she deserves to be beat up,she makes him do it,for chrissakes!!! Infuriating...almost every man I know has known a woman who has a story of some kind of abuse like this, and we're just as mad as they are,and not going to take it anymore goddamnit!!!

Expand full comment
P. J. Schuster's avatar

There are a small number of states that do have laws where if police are called for domestic abuse, they must make an arrest whether the victim wants to press charges or not. Trump is out of jail on bond. Part of remaining out is that you not commit another crime while on bond. Why in hell isn’t his probation officer revoking his bond since he broke the law? We all know if that was a young Black man who broke the law while out on bond, he would be revoked in a heartbeat.

You are correct, as the first black president, he had to walk a very straight line lest he affect the chances of getting another POC elected. He could not be seen as "an angry black man".

"the reason Obama plays it so cool is that he fears alienating white voters by coming across as an angry African-American male. Back in the summer, Ta-Nehisi Coates, a senior editor at The Atlantic, broke with the reticence about discussing this subject publicly. In a widely circulated essay entitled “Fear of a Black President,” Coates wrote,

Part of Obama’s genius is a remarkable ability to soothe race consciousness among whites. Any black person who’s worked in the professional world is well acquainted with this trick. But never has it been practiced at such a high level, and never have its limits been so obviously exposed. This need to talk in dulcet tones, to never be angry regardless of the offense, bespeaks a strange and compromised integration indeed, revealing a country so infantile that it can countenance white acceptance of blacks only when they meet an Al Roker standard."

I suspect we will see Trump continue to implode. He's now a cornered animal who has never been held criminally accountable for his actions. While this corrupt SCOTUS insulated him with immunity from "official acts" he is still vulnerable to conviction and prison time for a multitude of serious crimes against the United States. He recognizes that if he is not sworn in as President it is likely he will either be fleeing the country or will be spending 2025 in criminal court.

Personally, I'm looking forward to at least 20 seasons of "The Prison Apprentice" or "Orange is the New Orange" depending on whether NBC or Netflix wins the bidding war.

Trump appeared to suggest the incident stemmed from his campaign’s use of photography, sharing a statement from the family members of the fallen soldiers expressing their approval in a post on Truth Social.

“We had given our approval for President Trump’s official videographer and photographer to attend the event, ensuring these sacred moments of remembrance were respectfully captured and so we can cherish these memories forever,” the families said.

BUT

NPR’s Stephen Fowler says the Gold Star families that invited Trump gave him approval for a videographer and photographer to document the emotional moment, but families don’t have the power to suspend the rules. NPR also learned the family of a Green Beret whose headstone was visible in Trump’s footage didn’t give permission to be included. A Trump campaign representative said the Arlington staffer was “clearly suffering from a mental health episode.” JD Vance, Trump’s vice presidential nominee, said yesterday that Vice President Harris could “go to hell” over the Afghanistan withdrawal and blamed reporters for the controversy.
